Terms of Service

DO'S & DON'TFeel free to ask, I mostly draw characters in my style, mildly suggestive/NSFW is okay.I don't draw heavily sexual stuff, futanari, pregnancy, loli etc...WORK PROCESS AND CLIENT CONFIRMATIONAt certain stages of the project, the artist may check in with the client, to get their feedback on the artwork, as it progresses. Larger projects require more client confirmations than smaller projects. This can be discussed in greater detail during the negotiation process.SCOPE OF WORK (STATEMENT OF WORK)The client must provide a detailed description of the work to be done, outlining all important visual aspects of the desired artwork. The information must be clear and to the point. This includes, but is not limited to:- Physical descriptions of characters
- Clothing and equipment
- Environment, setting, period, scene, and mood
- Character actions and expressions
Visual references, such as drawings or photos, are recommended when outlining difficult to describe details.Any details left unexplained will be left up to the artist's discretion. For example, if the client says that a part of the drawing will be left up to the artist, then it is left up to the artist. This is why the description is so important. This is non-negotiable.Acceptable methods for making changes to the Scope of Work are outlined below, under "REVISIONS".For clarification, a "scope of work" document can simply be the email conversation between the client and artist, or note, or any other written method of communication, made during the negotiation process.For larger projects, it's best to write up a separate document such as a PDF, but for simple scenic of character commissions, an email conversation serves as a perfectly fine "scope of work" document.REVISIONSThe artist is responsible for:- Revising any errors made from failing to follow the description outlined in the Scope of Work document.An example of such a failure would be drawing blue eyes when the description clearly stated green eyes.- Any unrequested additions that the artist may have made that wasn't necessary.An example would be adding a scar to the face, when the Scope of Work document does not mention a scar.This is up to the client's discretion, and should be discussed. However, any undefined aspect of the drawing that is necessary, such as a character's body type, is not the artist's responsibility to revise, if the client does not like the outcome.
Any undefined, yet necessary aspect of the art falls under the artist's creative freedom. Using the above examples, a scar is not necessary, but a body type is.
The artist is NOT responsible for:- Revising anything that is outside of the description in the Scope of Work document.This includes changes that are requested by the client that do not align with what is written in the scope of work document. Even if the client decides they are not satisfied with the outcome of the original description, it is not the artist's responsibility to revise such changes.If the client wishes to have the artist make changes beyond what is outlined in the Scope of Work document, then a revision fee must be discussed and paid before such changes will be made.PAYMENT METHODSPayments must be made through Paypal invoice, with USD currency.- Payments are to be made up front, before work is done.
- On projects larger than $600, half payment can be made up front, and half payment made on delivery of line art.
- Refunds are at the artist's discretion, however a refund will not be given after work has started.
COPYRIGHT AND LICENSINGThe standard labor rates for a commissioned illustration do not include any licensing for the artwork. If specific permissions wish to be obtained, then such requests must be discussed with the artist, and written out in a legally binding contract. A special fee will apply for the purchasing of such permissions to be official.The client may do the following with the artwork, if no licensing is purchased:- Print a single copy for display in their own home or office.
- Display the artwork on their website in a non monetizing way, with credit and links to the artist's website. This is at the artist's discretion, and can be discussed.
The client may NOT do the following with the artwork, if no licensing is purchased:- Edit or change the work.
- Monetize the artwork.
- Distribute the artwork.
- Use the artwork for profit or nonprofit advertising.
- Do anything with the artwork that lies outside of what a non-owner can do with copyrighted material.
